This Privacy Policy (“Policy”) describes the information practices of LowKei Photography, operated by Keith, Chattanooga, Tennessee metropolitan area (“LowKei Photography,” “we,” “us,” or “our”). This Policy applies to all personal information collected through this website (lkshot.com), our online booking system, our client portal, and all communications between you and LowKei Photography in connection with our services.
This Policy is incorporated into and made part of our Terms of Service. By using this website or engaging our services, you consent to the collection, use, and disclosure of your personal information as described in this Policy.
We are committed to compliance with applicable United States privacy law, including the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”) where applicable, and the Telephone Consumer Protection Act (“TCPA”) governing electronic communications.
Information We Collect
We collect information you provide directly to us and information generated through your use of our website and services. The categories of personal information we collect include:
Identification & Contact Information:
- Full name (first and last)
- Email address
- Mobile telephone number (if SMS opt-in is selected)
- Mailing address (street, city, state, ZIP code)
Booking & Service Information:
- Selected service type, package, and add-ons
- Requested session date, time, and location
- Special requests, notes, or communications exchanged prior to and following sessions
- Booking reference numbers and session history
Payment Information:
- Payment transaction records (amounts, dates, and confirmation numbers)
- Payment method type (card type, last four digits) as retained by our payment processors
We do not collect or retain full payment card numbers, bank account information, Social Security numbers, government-issued identification numbers, or other sensitive financial identifiers. All payment processing is handled by PCI-DSS compliant third-party processors.
Technical & Usage Information:
- IP address and general geographic location (city/region level)
- Browser type, operating system, and device type
- Pages visited, time spent on pages, and referring URL
- Cookie identifiers (see Section 10)
How We Use Your Information
LowKei Photography uses collected personal information exclusively for the following purposes:
- Processing, confirming, managing, and fulfilling your photography booking
- Communicating with you regarding your booking status, session reminders, and post-session deliverables
- Processing payments and maintaining financial records as required by law
- Delivering edited photographs and gallery access credentials to you
- Responding to your inquiries, requests, and communications
- Improving the functionality and user experience of this website
- Maintaining internal business records and complying with legal obligations
- Sending occasional re-engagement communications to past clients (opt-out available at any time)
We do not use your personal information for automated profiling, behavioral advertising, data brokerage, algorithmic decision-making that produces legal or similarly significant effects, or any purpose materially inconsistent with the purposes described above.
Communications — SMS & Email
Effective communication regarding your booking is essential to delivering our services. Accordingly, our communications policy is as follows:
You Must Select At Least One Channel. When booking a session, you are required to designate either email or SMS as your preferred communications channel. You may not decline both channels, as one is necessary to deliver booking confirmations, reminders, and status updates. You may select both channels if you wish to receive notifications via both methods.
Email. By providing your email address, you consent to receive booking-related emails including confirmations, reminders, invoices, gallery delivery notices, and follow-up communications. You may opt out of non-transactional (marketing) emails at any time using the unsubscribe link in any such email, or by contacting us directly. Booking-critical transactional emails cannot be opted out while a booking is active.
SMS / Text Messaging. SMS is entirely voluntary. If you opt in at time of booking, you consent to receive text messages including session reminders, booking updates, and the option to cancel your booking via text. Consent to SMS is not required as a condition of purchasing services — you may select email as your sole communication method. You may revoke SMS consent at any time by:
- Replying STOP to any text message from us
- Emailing info@lkshot.com with your opt-out request
- Calling or texting us at (423) 646-0504
Message and data rates may apply per your mobile carrier plan. Message frequency varies based on booking activity, typically not exceeding two (2) to three (3) messages per booking lifecycle.
No Sale or Sharing of Personal Information
LowKei Photography does not sell, rent, lease, license, trade, or otherwise transfer your personal information to any third party for their independent commercial purposes. This is an unconditional commitment with no exceptions.
We do not participate in data broker arrangements, advertising networks, affiliate marketing programs that require disclosure of client data, or any other arrangement that results in your personal information being made available to parties outside of LowKei Photography and its operational service providers (described in Section 6).
This prohibition applies regardless of the nature of the third party, the form of consideration offered, or any claim that the data has been “anonymized” or “aggregated.” We do not engage in these practices.
In the event of a merger, acquisition, or sale of all or substantially all of the assets of LowKei Photography, we will provide written notice to affected clients prior to the transfer of any personal information, and will require any successor entity to honor the terms of this Privacy Policy.
Third-Party Service Providers
We engage a limited number of carefully selected third-party service providers who assist us in operating our website and delivering our services. These providers access your personal information solely to perform services on our behalf and are contractually prohibited from using your information for any other purpose.
Current categories of service providers include:
- Payment Processing: Stripe, Inc. and/or Square, Inc. — for secure processing of session deposits and fees
- SMS Delivery: Twilio, Inc. — for transmission of opt-in text message notifications
- Email Delivery: Google Gmail API — for transmission of booking confirmations and communications
- Website Hosting: WordPress hosting infrastructure
Each of these providers maintains their own privacy and security policies and is subject to applicable data protection regulations. We encourage you to review the privacy policies of these providers if you have questions about their individual data practices.
We may be required to disclose personal information in response to lawful requests from government authorities, court orders, subpoenas, or other legal process. We will provide notice to affected users where legally permissible prior to any such disclosure.
Data Security
LowKei Photography implements commercially reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, alteration, and destruction. These measures include secure server infrastructure, encrypted data transmission via HTTPS/TLS, access controls limiting data access to authorized personnel only, and regular security reviews.
However, no method of internet transmission or electronic storage is completely secure. While we employ robust security practices, we cannot guarantee the absolute security of your information. In the event of a security incident that may compromise your personal data, we will notify affected individuals as required by applicable law.
You are responsible for maintaining the confidentiality of any account credentials used to access our client portal, and for promptly notifying us of any unauthorized access to your account.
Data Retention
We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to provide our services, to comply with our legal obligations (including tax record retention requirements under applicable law), to resolve disputes, and to enforce our agreements.
Specifically:
- Active booking records are retained for the duration of the booking lifecycle and for a minimum of three (3) years thereafter
- Financial transaction records are retained for a minimum of seven (7) years as required by tax law
- Client contact information is retained in our client database until you request deletion, subject to legal retention requirements
- Marketing communication preferences and opt-out records are retained indefinitely to honor your preferences
Upon written request, and subject to our legal retention obligations, we will delete or anonymize your personal information within a reasonable period.
Your Rights & Choices
Subject to applicable law, you have the following rights regarding your personal information:
- Access: You may request a copy of the personal information we hold about you
- Correction: You may request correction of inaccurate or incomplete personal information
- Deletion: You may request deletion of your personal information, subject to our legal retention obligations
- Opt-Out of SMS: You may opt out of SMS communications at any time by replying STOP or contacting us directly
- Opt-Out of Marketing Email: You may opt out of non-transactional marketing emails using the unsubscribe link in any such email
- Portability: You may request a machine-readable copy of personal information you have provided to us
To exercise any of these rights, please contact us at info@lkshot.com. We will respond within thirty (30) calendar days of receiving a verifiable request. We will not discriminate against you for exercising any of your privacy rights.
Cookies & Tracking Technologies
This website uses cookies and similar tracking technologies to enhance user experience, maintain session state, and analyze aggregate website usage. The categories of cookies used include:
- Essential Cookies: Necessary for the website to function, including session management for the booking system and client portal. These cannot be disabled without impairing website functionality
- Analytics Cookies: Used to understand how visitors interact with the website on an aggregate, anonymized basis. We do not use third-party behavioral advertising cookies
You may configure your browser to refuse cookies or to alert you when cookies are being sent. Note that disabling certain cookies may affect the functionality of the booking system or client portal. We do not respond to browser “Do Not Track” signals at this time, as no universal standard for such signals has been adopted.
Children’s Privacy
This website and our online booking services are not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen without verifiable parental consent. If you are a parent or guardian and believe that your child has provided personal information to us, please contact us immediately at info@lkshot.com and we will take prompt steps to delete such information.
For photography sessions involving minor subjects, the written consent of a parent or legal guardian is required as set forth in our Terms of Service, and all personal information related to minor subjects is handled with heightened care and confidentiality.
California Privacy Rights
If you are a California resident, you have specific rights under the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”), including the right to know what personal information we collect, use, and disclose; the right to delete personal information; the right to correct inaccurate personal information; and the right to opt out of the sale or sharing of personal information.
As stated in Section 5, LowKei Photography does not sell or share personal information. Accordingly, there is no “opt out of sale” mechanism required. To exercise your other California rights, please contact us as provided in Section 14.
California residents may also designate an authorized agent to submit requests on their behalf. We may require verification of your identity and, where applicable, written authorization of any agent.
Changes to This Policy
We reserve the right to update or modify this Privacy Policy at any time. Material changes will be communicated by updating the “Last Revised” date at the top of this document and, where practicable, by direct notification to active clients. Your continued use of this website or our services following any modification constitutes your acceptance of the revised Policy.
