Acceptance of Terms
By accessing this website (lkshot.com) and booking services with LowKei Photography (“we,” “us,” or “the Photographer”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.
Booking and Payments
A. Deposits
To secure a date on our calendar, a non-refundable deposit of 25% of the total session fee is required at the time of booking. No date is reserved until this deposit is received.
B. Payment Methods
We accept payments via Cash, Venmo, PayPal, and Cash App. The remaining balance of your session fee is due in full on the day of the session.
C. Travel Fees
Sessions located within a 30-mile radius of Ider, AL, or Chattanooga, TN, incur no travel fees. Locations outside of this radius will be charged a travel fee of $0.68 per mile (round trip) to cover fuel and travel time.
Cancellations and Rescheduling
A. Client Rescheduling
We understand that life happens. We offer one (1) free reschedule per booking for emergencies or illness, provided that notice is given at least 24 hours in advance. Subsequent reschedules may incur a re-booking fee.
Weather Policy
For outdoor and automotive sessions, weather is a key factor. If the Photographer determines that weather conditions (rain, storm, extreme wind) will negatively impact the equipment or the quality of the final images, we will reschedule the session to the next best available date at no additional cost.
No-Shows
If a client fails to appear for a scheduled session without prior notice (“no-show”), the 25% deposit is forfeited, and a new deposit will be required to book a future date.
Artistic Style and Editing
A. Creative Control
By booking LowKei Photography, you acknowledge that you are familiar with our portfolio and style. Our “LowKei” style emphasizes dramatic lighting, authentic moments, and specific color grading. The Photographer has final say on the artistic selection of images delivered.
B. Retouching
Our editing includes color correction, exposure adjustment, and light balancing. We do not perform heavy body manipulation, extensive skin smoothing, or removal of permanent physical features (scars, etc.). We aim to capture the authentic subject.
C. RAW Files
We do not deliver RAW (unedited) files under any circumstances. The editing process is a vital part of the final artistic product.
Image Usage and Copyright
A. Copyright
LowKei Photography retains the copyright to all images created during the session, as protected by United States Copyright Law.
B. Personal Usage License
Upon delivery of the final gallery, the Client is granted a perpetual, non-exclusive license for personal use.
- You MAY: Print photos for personal use, share them on personal social media accounts, and display them in your home.
- You MAY NOT: Sell the images, enter them into contests, or use them for commercial advertising without express written permission and a commercial release from the Photographer.
C. Social Media Integrity
If you share images on social media, you agree not to apply filters (e.g., Instagram filters) or crop the images in a way that alters the Photographer’s original editing work.
Model Release
Unless otherwise agreed upon in writing, the Client grants LowKei Photography the right to use images from the session for portfolio display, website promotion, social media marketing, and professional competitions.
Limitation of Liability
A. Equipment Failure & Data Loss
In the unlikely event of a catastrophic mechanical failure, camera malfunction, or data loss that prevents the delivery of images, the liability of LowKei Photography shall be limited to the full refund of all monies paid by the Client.
B. Safety
The Client assumes full responsibility for their own safety and the safety of their property (including vehicles in automotive shoots) during the session. LowKei Photography is not liable for accidents or damages that occur during the session unless caused by the direct negligence of the Photographer.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Alabama and the United States.
